Reinstating a Lapsed Counseling License: Three States, Three Clocks

An expired counseling license is usually recoverable, but each state starts a different clock the day it lapses. Virginia, California and Texas show how much the rules differ, and why the first move is to stop practicing under it.

Most lapsed counseling licenses can be reinstated, but the rules depend on the state and how long it has been. Virginia requires 20 CE hours per year expired, capped at 80. California cancels a license not renewed within three years, forcing a new application. Texas requires fingerprints, an NPDB query and any required exams and CE.

Licenses lapse for ordinary reasons. A renewal notice went to an old address. A counselor took a year off for a new baby or a sick parent and stopped thinking about the second-state license nobody was using. A clinician moved abroad. The license expired quietly, and now there is a reason to want it back.

Before anything else: if you have been seeing clients in that state since the expiration date, stop, and talk to the board or a licensing attorney about how to handle it. California's renewal form, for example, says plainly that it is illegal to practice on an expired license outside an exempt setting, and that you are not entitled to payment for services performed while the license is expired.

Why does the length of the lapse matter so much?

Most states have a sliding scale. A license that expired last month can usually be renewed late with a fee. One that has been expired a year or more moves into reinstatement, which brings back some requirements. Past a final limit, some states cancel the license and you start over as a new applicant. Where your license sits on that scale decides almost everything.

Virginia: CE for each year away

Virginia's Board of Counseling uses a reinstatement application for LPC licenses expired one year or longer. You owe 20 hours of board-approved CE for each year the license was expired, capped at four years and 80 hours, and the hours must include at least 2 on the ethics, standards of practice or laws governing behavioral science professions in Virginia. The board says approval typically takes 45 to 60 days from a complete application, and it accepts proof of an out-of-state license as part of the file.

California: a three-year cliff

California's Board of Behavioral Sciences does not offer a grace period on renewal; a renewal postmarked after the expiration date owes the delinquent amount. The harder line is three years. According to the board's renewal form, a license not renewed within three years of its expiration date is canceled, and to be licensed again you must reapply, meet all current requirements and pass the licensing exams. For an LPCC, that means the current education rules and the exams, which can be a heavy lift for a counselor licensed under older standards.

If you know you will step away, California's inactive and retired statuses exist for that reason. Retired licenses have their own limit: a license retired for three years or longer cannot be reactivated.

Texas: the council's reinstatement rule

Texas handles reinstatement under a Behavioral Health Executive Council rule that applies across its member boards. A reinstatement application requires the application fee, a fingerprint-based criminal history check showing no disqualifying history, a National Practitioner Data Bank self-query, and passage of any exams and completion of any CE the counseling board requires. If a license was revoked or resigned, you cannot apply for reinstatement until a year after the effective date. For a Texas LPC, remember that the jurisprudence exam is part of every renewal anyway.

What should you gather first?

  1. Look up the license on the board's public verification site and note the exact expiration date and status (expired, canceled, inactive).
  2. Read the state's renewal and reinstatement rule for that status, not a general FAQ.
  3. Collect CE certificates from the lapse period. Hours earned for another license often count, if the provider is acceptable.
  4. Get verifications for every other license you hold, active or not. Most reinstatement applications ask.
  5. Answer the practice question honestly. Applications usually ask whether you practiced while expired. An honest answer with context is far better than a discovered omission.

If your home license is the one that lapsed and you hold compact privileges, those privileges depend on it. Privileges expire with the home license, so a lapse at home takes the privileges with it. Common questions

My California LPCC expired 4 years ago. Can I just renew it?
No. California cancels a license that is not renewed within three years of expiration. You would apply as a new applicant, meet the current requirements and pass the licensing exams.
How much CE do I need to reinstate a Virginia LPC?
Twenty hours of board-approved CE for each year the license was expired, up to four years and 80 hours, including at least 2 hours on Virginia ethics, standards of practice or law.
Does my compact privilege survive if my home license lapses?
No. A privilege expires on the same date as your home-state license. If the home license lapses, so do the privileges built on it.
Can I keep seeing clients while my reinstatement is pending?
Not in the state where the license expired, unless you work in a setting that state exempts from licensure. Practicing on an expired license is unlicensed practice.
